Browse Programs Admission InformationAs part of the efforts to promote the university's scientific mission and the urgent need for such specializations that align with the university's aspirations to engage with the external environment, the university also contributes with its scientific competencies to the integrated development of society.
In response to the aspirations of the Department of Shari’a and Law at Emir Abdelkader University to fulfill its mission, and the implementation of the recommendations of the Ministry of Higher Education in developing university scientific research, it was proposed to open a doctoral program (third cycle) within the LMD system, entitled: Shari’a and Law.
The content of the program in the field of Shari’a and Law is based on the comparative study between religious concepts and other legal concepts in modern fields, which require in-depth study and clarification in order to keep up with new developments and to research religious issues that are also of interest to positive laws, and to show the similarities and differences.

1- Theoretical Studies in Shari’a and Law:
Criminal Law and Criminal Justice:
Comparison between crimes and penalties: Analysis of the similarities and differences in the definition of crimes and types of penalties in Shari’a and positive law (such as Hudud, Qisas, and Tazir compared to misdemeanors and felonies).
Concept of procedural justice: Comparative study of the legal guarantees of the accused and the rights of the victim in the stages of investigation and trial in both systems.
Alternatives to punishment and restorative justice: Are there similar concepts in Shari’a (such as reconciliation and pardon) to what is known as restorative justice in positive law?
Combating modern crime: How do the two systems deal with cybercrime, money laundering, and terrorism?
2- Comparative research methodologies between Shari’a and Law
Training on the use of comparison tools between Shari’a and Law
3- Critical and applied analysis:
Enabling the student to assess the points of convergence between Shari’a and positive laws, as well as the points of divergence.
Activating the comparative method in addressing contemporary issues.
4- Preparation for original scientific research:
Qualifying the student to formulate research on human rights through comparative studies.
5- Keeping up with new developments and collective scholarly work:
Studying the efforts of jurisprudence academies and scientific conferences, as well as the philosophies and new ideas on human rights issues.
International students are eligible to apply for enrollment in the third-cycle (doctoral) program under the following conditions:
1. Possession of a Baccalaureate certificate (Secondary School Certificate) or its equivalent.
2. Possession of a Licence (Bachelor’s degree) or its equivalent.
3. Possession of a Master’s or Magister degree, or its equivalent.
4. If the applicant does not speak Arabic, he or she is required to complete a one-year Arabic language training program at the university’s Center for Intensive Language Instruction
