Browse Programs Admission InformationIn the framework of advancing the university’s scientific mission and the urgent need for specialties that align with the university’s aspirations and the country’s current stage, which requires the university to connect with its external environment and contribute with its scientific competencies to the integrated developmental domain of society, the following was proposed:
In response to the aspirations of the Department of Fiqh and Its Foundations at Emir Abdelkader University to fulfill its mission, and to implement the Ministry of Higher Education’s recommendations for developing university scientific research, the opening of a third-cycle doctoral program under the LMD system titled Maliki Fiqh and Its Foundations was proposed.
The training content in Maliki Fiqh is based on studying Maliki jurisprudential heritage both fundamentally and in its branches, with an approach that benefits from it in new jurisprudential issues through a research methodology integrating both substantive and formal dimensions. This allows balancing between the various juristic opinions within the school and assessing their evidences according to the principles of the school’s Imam and their jurisprudential implications. The training also aims at evaluating and renewing the methodological principles in Maliki jurisprudence to serve contemporary Islamic jurisprudence.
The program also covers studying contemporary jurisprudential issues in light of the Imam’s school in areas such as financial transactions, worship, and family, comparing between the jurisprudential opinions within the school and other Islamic schools to determine the most sound opinions.
It seeks to open horizons for research and study in Maliki Fiqh through critical, analytical, and in-depth jurisprudential approaches, responding to the school’s aspirations by addressing its issues with academic research and discussions on contemporary life challenges in various aspects, aiming to serve scientific fields and embody the interconnection of the school’s jurisprudential concepts with real life developmentally, politically, economically, and educationally, contributing to the university’s role in proposing programs, visions, and projects that form a foundation for future generations to preserve jurisprudential references.

The study of Maliki Fiqh progresses from descriptive and traditional levels to analytical, comparative, contemporary application, and realistic jurisprudential implementation. Focus is on advanced topics requiring high scientific skill and precise research methods, such as:
1. Ijtihad and Fatwa in Maliki Fiqh (Levels of ijtihad within Maliki school, fatwa on new issues between foundation and application, rules for preferring opinions within the school, contemporary fatwa challenges in Maliki environment).
2. Maliki Jurisprudential Rules and Their Contemporary Applications (Imam Malik’s specific rules like "blocking the means", public interest rules, and others, and their applications in financial, medical, and family issues).
3. Objectives of Sharia in Maliki Fiqh (Maliki methodology in preserving objectives, the role of objectives in preferring opinions, application of objectives in contemporary jurisprudence, such as freedoms, environment, modern financial contracts).
4. Jurisprudence of Contemporary Issues in Maliki Fiqh (Extensive study of "jurisprudential new issues" in classical texts and contemporary analysis from a Maliki perspective).
5. Judiciary and Justice in Maliki Fiqh (Judicial organization in Maliki school, study of "Guidance for Judges" by Ibn Farhun as a practical model, family and financial judiciary in Maliki fiqh).
6. Methodologies of Authorship in Maliki Fiqh (Types of writings, analytical study of key Maliki texts, and the scientific methodology in explanation and annotation).
7. Maliki Fiqh and Contemporary Reality (Relationship with positive legislation, suitability for civil and family codification, jurisprudence of modern transactions like Islamic banking, insurance, companies).
8. Maliki Schools and Scholars (Development of Maliki schools in Medina, Maghreb, Andalusia, their characteristics, and efforts in renewal).
International students are eligible to apply for enrollment in the third-cycle (doctoral) program under the following conditions:
1. Possession of a Baccalaureate certificate (Secondary School Certificate) or its equivalent.
2. Possession of a Licence (Bachelor’s degree) or its equivalent.
3. Possession of a Master’s or Magister degree, or its equivalent.
4. If the applicant does not speak Arabic, he or she is required to complete a one-year Arabic language training program at the university’s Center for Intensive Language Instruction
